Last Will and Testament
In the name of God amen. I Martin Burnill of HaverahPark Hea
d in the Parish of Fewston and County of York yeoman being weakl
y in body but of perfect mind and memory thanks be given to God
: Calling to mindthe mortality of my body and knowing that it i
s appointed for all men once to die do make and ordain this my L
ast Will and Testament (that is to say) principally and first o
f all I give and recommend my Soul into the hands of thealmight
y God that gave it and my body I recommend to the earth to be bu
riedat the discretion of my Executor hereafter, nothing doubtin
g but at the General Resurrection I sHall receive the same agai
n by the mighty power of God, and as touching such worldly estat
e as it hath pleased God to Bless me with inthis Life. I giv
e and devise and dispose of the sum in the following manneran
d form.
First my Will and Mind is that my Houses and Lands at Roddle (sp
) be exposed to Sale and Sold by auction to the best bidder an
d the money arising by it to be expended in paying all my Lawfu
l debts and Funral Expensesby my Executor hereafter named and t
he reversion and remainder of the purchase money to go towards p
aying my legacies (which are as follows). Likewise mywill an
d mind is that Margret my beloved wife sHall be paid six pound
s yearly and every year by my executor during her natural Life b
y four quarterly payments the first payment to be made and begi
n the Day after my decease and for non-payment she sHall enter u
pon any part of the Housing and Lands which was my right and pro
perty at my decease till paid. Likewise Liberty to dwellin ou
r now dwelling house which May Day next and to have Liberty of h
er Cowmilking and keeping till then. Likewise all the househol
d furniture which was her own at Marriage to have at her own dis
posal or any her household furniture within the house she choose
s to keep for her own use not to be denied ofthe same during he
r natural Life and at May Day if she Chooses to dwell andhave H
ouseroom in the oast apartment of the house not to be disturne
d untilshe can mend herself.
Likewise my will and mind is and Give and Bequeath to my Daughte
r Hannah two Shillings and Six pence to be paid at my decease
. Likewise I give to my Son George the sum of thrity pounds t
o be paid by my executor ten pounds a year after my decease an
d the other twenty pounds at the decease of my wife. Likewis
e I give to my Son James twenty five pounds to be paid by my Exe
cutor tend pounds a year after my decease and fifteen pounds a
t my Wife's decease. Likewise my Maro(sp) and cast plow and Har
rows and thefixtures about my Dwelling house fires. Likewise m
y Cow at May Day if I be not alive to enjoy her myself. Likewis
e I give to my son Martin the sum of twenty pounds to be pai
d a year after my decase. Likewise I give to my son William th
e sum of twenty pounds to be paid a year after m y decase. An
d my will and mind is that for non-payment of any of the above m
entioned Legacies be unpaid at the above mentioned times my wil
l and mind is that they sHall enter upon my part and parcel of m
y estate which was my property at my decease till the same is pa
id and discharged. Likewise I give, demise and dispose ofto m
y Son John all my Houses Lands and Estate both real and persona
l to beby him enjoyed together with all my Household goods (Exc
ept what before mentioned) to him his Heirs and assignees foreve
r his paying all my Lawfull debtsand funeral Expenses as abov
e mentioned; and I likewise constitute make and ordain him the s
aid John Burnill full and sole Executor of this my Last Will an
d Testament and I do hereby utterly revoke and disannull and dis
allow allother former Testaments Wills Legacies Bequeaths and E
xecutors by me in any wise before named Will'd and Bequeathed Ra
tifying and confirming this and no other to be my Last Will an
d Testament in Witnes
