Benjamin was appointed the first judge of Franklin Co under th
e territorial administration, and made the first land entry in t
hat county May 25, 1803, andbuilt the first log cabin in Frankl
in County. His first act as a judge wasto appoint commmissione
rs to take charge of the school lands of the county and to dispo
se of them for the public good. Judge McCarty and his wife spen
ttheir last Days on their pioneer farm in the vicinity of Brook

On May 25, 1803, the first land entry in thecounty was made b
