At Askham 22nd November 1854 on which day appeared personally Stephen Mounsey of Setra Park in the Parish of Askham in the county of Westmorland and diocese of Carlisle, farmer and alleged that he was and is the sole executor named in the last will and testament of John Mounsey late of Setra Park in parish of Askham in the county of Westmorland and the diocese of Carlisle, yeoman who died 16 July 1854 etc This is the Last Will and Testament of me John Mounsey of Setra Park in the Parish of Askham in the County of Westmorland, Yeoman. I give and divise unto my son John Mounsey his heirs and assigns all my messuage Tenement and Lands situate at Widewath in Heltondale in the said Parish of Askham subject nevertheless to the payment of two hundred pounds which I expressly charge the same as hereafter mentioned that is to say to pay the interest of the said sum of two hundred pounds after the rate of four pounds per cent until Agnes Mounsey the widow of my late son Thomas Mounsey deceased for and during the term of her natural life the first years payment to be made at the end of twelve months next after my decease. And upon the death of the said Agnes Mounsey I give the said sum of two hundred pounds equally amongst her four children by my said son Thomas Mounsey share and share alike and if any of them the said four children shall die in the lifetime of their said mother having a child or children I give the share of such of them so dying unto such child or children to be divided equally amongst them if more than one and if but one the whole to such one child. But if any of them the said four children shall die in the lifetime of their said mother without leaving child or children I give the share of him or her so dying unto the surviving or survivor of them in equal shares if more than one and if but one the whole to such survivor. I give and divise unto my son Stephen Mounsey my dwelling house, out houses and croft situate in Helton purchased by me of John Mounsey. Also three classes situate in the town fields of Helton called High Ruans, Low Ruans and Heldrons. To hold to my said son Stephen his heirs and asigns I give to my daughter Ann the wife of Thomas Bowman the sum of two hundred payable twelve months next after my desease. I givre and bequeath unto my said son Stephen all my household furniture, stock, crop and farming utensils also all other personal estate and effect whatsoever and wheresoever subject and chargable however to the payment of the said legacy of two hundred pounds to my said daughter Ann and all my just debts funeral and testamentary expences and I appiont my said son Stephen sole executor of this my will and testamony whereof I the said John Mounsey have hereunto set my hand and seal the 10th day of April one thousand eight hundren and thirty eight.
Signed sealed and published by the said John Mounsey the testator as and for his last will and Testament in the presence at his request and in the presence of each other have hereunto subscribed our names as witnesses.
