In the name of God Amen I Thomas Smith of Morley in the county of Derby yeoman being of sound mind and understanding praised be God and being mindfull of my mortallity do make and ordain this my last will and testament in order and manner following. First of all I command my soul to the mercy of Almighty God and my body to the earth to be decently interred at the discretion of my executors hereinafter named. As to my worldly estate I dispose of it in manner following. First for payment of all my just and lawfull debts and funeral expenses - I give and devise unto my beloved wife Susannah all those my lands houses tenements and other building situate lying and being in the parish of Haynor in the county of Derby for and during her natural life and at her death I give and devise unto my son Edward all that house and premises part of the said estate which is now in the tenure and occupation of William Woodhouse to him and his heirs and assigns forever. The remaining part of that estate I give and devise at the death of my said wife to my executors their heirs and assigns forever to enable them to pay such legacies as is hereinafter by me given and devised. I give and devise to my said wife over and above what is beforementioned the sum of twenty pounds to be paid in one month after my decease and also the sum of six pounds to be paid her yearly and every year during the term of her natural life, the same to be paid her quarterly that is to say the sum of one pound ten shillings in three months after my decease and the like sum of one pound ten shillings every three months during the term of her life. I give and devise to my daughters, Elizabeth, Mary, Ann, and Susannah and insomuch to each of them the sum of fifty pounds and to my daughter Martha the sum of one hundred and ten pounds to be paid them in twelve months after my decease and interest to be allowed and paid after the rate of four percent per annum from the time of my death. All the residue and remaining part of my estate of what nature and kindsoever I give and devise to my son William his heirs and assigns forever and I do hereby constitute and appoint my cousin William Hall of Cotes in the county of Leicester and my said son William joynt executors of this my last will and do hereby order that they shall each of them separately be accountable for what they shall do in the execution of this will and not one for the other of them. In witness whereof I have hereunto sett my name and seal this twelfth day of November in the year of our Lord one thousand seven hundred and eighty four, 1784.
